Important Steps in a Salt Lake City Bankruptcy Process
The timeline of filing bankruptcy in Salt Lake City, or Utah in general, is, from start to finish, generally the same regardless of whom you pick to be your bankruptcy attorney. What follows is how a typical case goes (yours may be different if it is more complex). In cases of emergencies, it will be less because we will file immediately, and in some other cases it may take a bit longer due to issues with the trustee holding it open.
Typical Timeline for Chapter 7 Bankruptcy in Utah
Day 1
Consult with your lawyer, fill out the
paperwork
Days 3 - 5
Your lawyer will prepare your claim and file your case. (No more calls from collections! Yeah!)
Days 30 - 45
You, along with your lawyer and trustee, will appear at the meeting of creditors.
Days 100 - 120
The discharge order is signed by the bankruptcy judge and your trustee closes your case. Free from debt at last!
Typical Timeline for Chapter 13 Bankruptcy
Day 1
Consult with your lawyer and fill out the paperwork.
Days 3 - 5
Your lawyer will prepare your claim and file your case. (No more calls from collections! Yeah!)
Days 30 - 45
You, along with your lawyer and trustee, will appear at the meeting of creditors. Right before this meeting is when your initial bankruptcy payment will be due.
Days 50 - 70
If there are any disagreements about the terms of your repayment plan, you’ll need to appear before the judge at confirmation hearing.
Months 3 - 36
During this time, you will send your monthly bankruptcy payments to your trustee, which he/she will then use to pay down your debts. This may, in some cases, be over a 60-month period rather than 36.
Years 3 - 5
You make your last required payment. The judge then signs the discharge order, your trustee signs the case as closed and…you’re done! No more debt!
